Terms governing use of Honesty Software services, estimates, and website content.

1. Agreement to These Terms

By accessing or using honestysoftware.com, submitting information through our site, creating an account, using our AI intake tools, requesting a proposal or estimate, or otherwise interacting with our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the site or services.

2. Services We Provide

Honesty Software provides software planning, intake, proposal, estimate, contract, scheduling, payment-related workflow support, project communication tools, and related consulting or development services. Site content, intake responses, estimates, and proposals are provided for business planning and service delivery purposes and do not constitute legal, tax, accounting, or financial advice.

3. Eligibility and Account Responsibilities

You represent that you are authorized to use the site and, if acting on behalf of a business or other entity, authorized to bind that entity. You are responsible for maintaining the confidentiality of your account credentials, for activities that occur under your account, and for the accuracy of information you submit.

4. Acceptable Use

Estimates may depend on assumptions, scope boundaries, dependencies, timelines, and information available at the time of preparation. Changes in scope, requirements, third-party dependencies, integrations, or delivery assumptions may require revised pricing or schedules.

7. Payment Terms

If you engage us for paid services, payment obligations will be governed by the relevant estimate, contract, invoice, payment schedule, or other written agreement. Failure to make payments when due may result in suspension of work, delayed delivery, withholding of deliverables, cancellation of milestones, or termination of services where permitted by law and contract.

8. Intellectual Property

All rights in the website, branding, software, templates, internal tools, workflow systems, documentation, and related materials remain the property of Honesty Software or its licensors unless a written agreement states otherwise. Client ownership, license rights, transfer terms, and deliverable usage rights are governed by the applicable contract or statement of work.

9. Confidentiality

We treat client project information as business-sensitive and use reasonable measures to protect it. At the same time, you acknowledge that electronic systems are not completely free from risk. Any additional confidentiality obligations, non-disclosure commitments, or handling requirements should be addressed in a written agreement where necessary.

10. Third-Party Services

Our services may depend on or integrate with third-party providers such as hosting providers, payment processors, cloud infrastructure, APIs, communication platforms, and external tools. We are not responsible for outages, failures, delays, pricing changes, content policies, or acts or omissions of third-party providers.

11. AI-Assisted Features

Some features may use automated or AI-assisted systems to organize information, generate summaries, prepare intake responses, or support pricing and workflow decisions. These outputs are assistive only and may require review, correction, or further discussion. You are responsible for reviewing materials generated through the service before relying on them for business decisions.

12. Disclaimers

To the fullest extent permitted by law, Honesty Software disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, and accuracy. 13. Limitation of Liability

To the fullest extent permitted by law, Honesty Software and its owners, personnel, affiliates, contractors, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of profits, revenues, data, goodwill, or business opportunities arising out of or relating to the site or services. Our aggregate liability for any claim arising from or related to the site or these terms will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid us for the specific services giving rise to the claim during the twelve (12) months preceding the event giving rise to liability.

14. Indemnification
